2. Eligibility and Account Registration

- One Account: Maintain only one account per person (multiple accounts may be terminated)

Buyer Accounts

- Access to favorites, order history, and reviews
- No approval required
Seller Accounts
- For listing and selling products on the marketplace
- Subject to approval and verification
- Must comply with seller policies and quality standards
- May require business documentation and identity verification
Affiliate Accounts
- For promoting products and earning commissions
- Subject to approval and affiliate program terms
- Must comply with affiliate marketing policies
2.4 Account Suspension and Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms or our policies
- You engage in fraudulent, illegal, or harmful activity
- You provide false or misleading information
- Your account is inactive for an extended period
- We determine termination is necessary for legal or business reasons
3. Marketplace Rules and Conduct
3.1 Prohibited Items and Activities
You may not list, sell, purchase, or promote:
Illegal or Regulated Items:
- Illegal drugs, controlled substances, or drug paraphernalia
- Weapons, firearms, ammunition, or explosives
- Stolen goods or items obtained through fraud
- Counterfeit currency, documents, or identification
- Items that violate export control or sanctions laws
Infringing or Unauthorized Goods:
- Counterfeit, replica, or knock-off products
- Items that infringe intellectual property rights (copyright, trademark, patent)
- Unauthorized branded merchandise
- Pirated digital content or software
Dangerous or Restricted Items:
- Hazardous materials or chemicals
- Prescription medications or medical devices
- Tobacco products or e-cigarettes (where prohibited)
- Alcohol (subject to local regulations)
- Adult content or services
- Live animals or endangered species products
Prohibited Services:
- Services that violate laws or regulations
- Multi-level marketing or pyramid schemes
- Services requiring professional licenses (unless properly licensed)
3.2 User Conduct
All users must:
Comply with Laws:
- Follow all applicable local, state, national, and international laws
- Respect intellectual property rights
- Honor consumer protection regulations
- Comply with tax and business registration requirements
Act Honestly and Fairly:
- Provide accurate and truthful information
- Not engage in fraudulent, deceptive, or misleading practices
- Not manipulate prices, reviews, ratings, or search rankings
- Not create fake accounts or use bots
Respect Others:
- Treat other users with respect and professionalism
- Not harass, abuse, threaten, or discriminate against others
- Not spam, phish, or send unsolicited communications
- Not impersonate others or misrepresent affiliations
Protect the Platform:
- Not interfere with platform operation or security
- Not attempt to gain unauthorized access to systems or data
- Not use automated tools (bots, scrapers) without permission
- Not circumvent security measures or access controls
3.3 Seller Responsibilities
As a seller on BugSell, you must:
Product Listings:
- Accurately describe products with clear, honest descriptions
- Provide high-quality, representative photos
- Specify all relevant details (size, color, materials, condition)
- Disclose any defects, damage, or limitations
- Set fair and transparent pricing
- Honor advertised prices and promotions
Order Fulfillment:
- Process orders promptly (within 1-3 business days)
- Ship products within stated timeframes
- Provide accurate shipping and delivery estimates
- Use appropriate packaging to prevent damage
- Provide tracking information when available
- Confirm shipment and delivery
Customer Service:
- Respond to buyer inquiries within 48 hours
- Provide professional and courteous support
- Address issues and complaints promptly
- Honor your stated return and refund policies
- Resolve disputes in good faith
Compliance:
- Comply with all applicable laws and regulations
- Collect and remit applicable taxes
- Maintain required business licenses and permits
- Follow product safety and labeling requirements
- Respect intellectual property rights
Quality Standards:
- Maintain high product quality
- Ensure products match descriptions and photos
- Package items securely and professionally
- Maintain positive seller ratings and feedback
3.4 Buyer Responsibilities
As a buyer on BugSell, you must:
Purchasing:
- Provide accurate shipping and payment information
- Complete purchases in good faith
- Pay for items promptly
- Not make fraudulent or unauthorized purchases
Communication:
- Communicate respectfully with sellers
- Ask questions before purchasing if uncertain
- Respond to seller messages in a timely manner
- Provide necessary information for customizations
Returns and Reviews:
- Follow seller's return and refund procedures
- Return items in original condition (unless defective)
- Leave honest, fair, and accurate reviews
- Not leave reviews in exchange for compensation
- Not threaten negative reviews to obtain refunds
4. Payments, Fees, and Pricing
4.1 Payment Processing
Payment Methods:
- All payments are processed through secure third-party payment gateways (primarily Stripe)
- Accepted payment methods: credit cards, debit cards, digital wallets
- By making a purchase, you agree to the payment processor's terms and conditions
- BugSell does not store complete credit card numbers
Payment Authorization:
- You authorize us to charge your payment method for purchases
- You represent that you have the right to use the payment method
- You are responsible for any fees charged by your bank or card issuer
4.2 Seller Fees and Commissions
Sellers are subject to the following fees:
Platform Commission:
- A percentage of each sale (typically 5-15%)
- Rate displayed in your seller dashboard
- Deducted automatically from sale proceeds
Payment Processing Fees:
- Charged by payment processors (typically 2.9% + $0.30 per transaction)
- Varies by payment method and region
- Deducted from sale proceeds
Additional Fees:
- Premium features or promoted listings (optional)
- Expedited payout processing (optional)
- Currency conversion fees (if applicable)
Fee Transparency:
- All fees are clearly disclosed before listing
- Detailed fee breakdowns available in seller dashboard
- No hidden fees or surprise charges
4.3 Payouts
Payout Schedule:
- Sellers can request payouts according to the schedule in their dashboard
- Minimum payout threshold applies (typically $25-$50)
- Payouts processed via Stripe Connect
Payout Timing:
- Standard payouts: 2-5 business days
- Expedited payouts: 1 business day (may incur additional fee)
- First payout may have extended hold period for verification
Payout Holds:
- Funds may be held for security review
- Holds applied for dispute resolution
- Holds for high-risk transactions or new sellers
- Holds released when issues are resolved
4.4 Pricing and Currency
Price Setting:
- Sellers set their own prices
- Prices must be fair and not misleading
- Prices displayed in buyer's selected currency
- Currency conversion rates provided by payment processors
Price Changes:
- Sellers may update prices at any time
- Price changes do not affect pending orders
- Sale prices and promotions must be honored
4.5 Taxes
Seller Tax Responsibilities:
- Sellers are responsible for determining applicable taxes
- Sellers must collect and remit sales tax, VAT, or GST as required by law
- Sellers must maintain proper tax records
- Sellers are responsible for income tax on earnings
Platform Tax Collection:
- BugSell may collect taxes on behalf of sellers where legally required
- Tax collection varies by jurisdiction
- Tax information available in seller dashboard
Buyer Tax Responsibilities:
- Buyers may be responsible for import duties, customs fees, or VAT
- International orders may incur additional taxes
- Buyers should check local regulations
5. Intellectual Property
5.1 Platform Content and Trademarks
BugSell Ownership:
- All content on the Platform (text, graphics, logos, software, design) is owned by BugSell or our licensors
- Protected by copyright, trademark, and other intellectual property laws
- "BugSell" and related marks are trademarks of BugSell
Restrictions:
- You may not copy, modify, distribute, or create derivative works
- You may not use our trademarks without written permission
- You may not reverse engineer or decompile our software
5.2 User Content License
Your Content:
- You retain ownership of content you post (listings, photos, descriptions, reviews)
- You grant BugSell a worldwide, non-exclusive, royalty-free license to:
- Use, display, reproduce, and distribute your content
- Modify and adapt content for platform operation
- Sublicense content to service providers
- Use content for marketing and promotional purposes
Your Representations:
- You own or have rights to the content you post
- Your content does not infringe third-party rights
- Your content complies with these Terms and applicable laws
5.3 Intellectual Property Infringement
Reporting Infringement:
- If you believe content infringes your rights, see our Intellectual Property Policy and DMCA Policy
- Submit takedown notices to ip@bugsell.com
- Provide required information for valid notices
Repeat Infringer Policy:
- We will terminate accounts of users who repeatedly infringe intellectual property rights
- Three strikes policy for verified infringement
Counter-Notices:
- If your content was removed, you may submit a counter-notice
- Follow DMCA counter-notice procedures
- Content may be restored if counter-notice is valid
5.4 Prohibited Use of Platform
You may not:
- Frame or mirror any part of the Platform
- Use automated tools to access or scrape the Platform
- Interfere with platform security or functionality
- Bypass access restrictions or authentication
- Use the Platform for unauthorized commercial purposes
6. Orders, Shipping, and Delivery
6.1 Order Process
Placing Orders:
- Orders are placed directly with sellers
- You enter into a contract with the seller, not BugSell
- BugSell facilitates the transaction but is not a party to the sale
Order Confirmation:
- You receive confirmation when order is placed
- Seller receives notification to fulfill order
- You can track order status in your account
Order Cancellation:
- Buyers may cancel before seller ships (subject to seller policy)
- Sellers may cancel if unable to fulfill
- Cancellation refunds processed according to payment method
6.2 Shipping and Delivery
Seller Responsibility:
- Sellers are responsible for shipping products
- Sellers must ship within stated timeframes
- Sellers must provide tracking when available
Shipping Costs:
- Shipping costs displayed at checkout
- Costs set by sellers based on shipping method and destination
- Free shipping may be offered by some sellers
Delivery Times:
- Delivery estimates are approximate, not guaranteed
- Delays may occur due to carrier issues, customs, or other factors

International Shipping:
- International orders may incur customs fees, duties, or taxes
- Buyer is responsible for additional fees
- Delivery times longer for international orders
6.3 Returns and Refunds

7. Disputes and Resolution
7.1 Buyer-Seller Disputes
Direct Resolution:
- We encourage buyers and sellers to resolve disputes directly
- Use our messaging system to communicate
- Work in good faith to find a solution
Platform Assistance:
- If direct resolution fails, contact our support team
- We may mediate disputes and provide guidance
- We may make final decisions in certain cases
Dispute Types:

- Item not as described
- Defective or damaged items

7.2 Chargebacks and Payment Disputes
Chargeback Policy:
- Fraudulent chargebacks may result in account suspension or termination
- Sellers may be held liable for chargebacks due to non-delivery or misrepresentation
- We may provide evidence to payment processors for chargeback disputes
Payment Disputes:

- We will work to resolve payment issues
- Unjustified chargebacks may result in fees or account restrictions
7.3 Limitation of BugSell's Role
Marketplace Platform:
- BugSell is a platform connecting buyers and sellers
- We are not a party to transactions between users
- We do not guarantee product quality, safety, or legality
- We are not responsible for seller conduct or product issues
No Warranty:
- We do not endorse or verify sellers or products
- We do not guarantee transaction outcomes
- Users transact at their own risk
8. Limitation of Liability
8.1 Platform "As Is"
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or availability
- Error-free or uninterrupted operation
8.2 Limitation of Damages
To the fullest extent permitted by law, BugSell shall not be liable for:
Indirect Damages:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Loss of goodwill or reputation
- Cost of substitute goods or services
User-Related Damages:
- Damages arising from user content, products, or conduct
- Damages from seller non-performance or product issues
- Damages from buyer payment issues or disputes
- Damages from third-party actions
Maximum Liability:
- Our total liability shall not exceed the amount paid by you to BugSell in the past 12 months
- Or $100, whichever is greater
8.3 Exceptions
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the fullest extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless BugSell, its affiliates, officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms or our policies
- Your violation of any third-party rights (including intellectual property rights)
- Your content, products, or listings
- Your conduct or interactions with other users
- Your breach of any representations or warranties
This indemnification obligation survives termination of these Terms and your use of the Platform.
10. Termination and Suspension
10.1 Termination by You
Account Closure:
- You may close your account at any time through account settings
- Closing your account does not relieve you of obligations for completed transactions
- Outstanding fees, refunds, or disputes must be resolved
Effect of Closure:
- Access to Platform features will be terminated
- Your content may be deleted (subject to legal retention requirements)
- You may not create a new account without our permission
10.2 Termination by BugSell
We reserve the right to suspend or terminate your account at any time, with or without notice, for:

- Violation of these Terms or our policies
- Fraudulent, illegal, or harmful activity
- Listing prohibited items or engaging in prohibited conduct
- Intellectual property infringement
Performance Issues:
- Excessive chargebacks or disputes
- Poor seller performance or ratings
- Failure to fulfill orders or provide customer service
Other Reasons:
- Inactivity or account abandonment
- Risk to platform security or integrity
- Legal or regulatory requirements
- Any reason at our sole discretion
10.3 Effect of Termination
Upon termination:
- Your right to use the Platform ceases immediately
- We may delete your account and content
- Outstanding financial obligations remain due
- You must cease using our trademarks and intellectual property
- Provisions that should survive (indemnification, liability limitations) remain in effect
10.4 Appeals
If your account is terminated, you may appeal by contacting support@bugsell.com with:

- Explanation of circumstances
- Evidence supporting your appeal
We will review appeals but are not obligated to reinstate accounts.
11. Governing Law and Dispute Resolution
